Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Brightmark platform — including the mobile application, website, and any related services — operated by Finedrawn Pte. Ltd. ("Brightmark", "we", "us", "our"), a company incorporated in Singapore.

By creating an account or using Brightmark, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the platform.

By using Brightmark, you represent that you have the legal capacity to enter into a binding agreement under Singapore law.

Brightmark is a tool for private home tutors. As a tutor, you are responsible for:

• Keeping your account credentials confidential and notifying us immediately if you suspect unauthorised access
• Ensuring that any student or parent data you enter into Brightmark is handled in accordance with Singapore's Personal Data Protection Act 2012 (PDPA)
• Obtaining appropriate consent from parents or students before logging their information in the app
• The accuracy of all lesson records, invoices, and payment information you create

Brightmark assists your workflow. We are not a party to any tutoring agreement between you and your students or their parents, and we are not responsible for disputes arising from those relationships.

You agree not to:

• Use Brightmark for any unlawful purpose or in violation of Singapore law
• Enter false, misleading, or fraudulent information into the platform
• Attempt to bypass, disable, or interfere with any security feature or access controls
• Scrape, copy, or extract content from Brightmark without our written permission
• Use Brightmark to send unsolicited communications or spam
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

Brightmark and all associated software, design, and content are the property of Finedrawn Pte. Ltd. and are protected by applicable intellectual property laws.

You retain ownership of the data you enter into Brightmark — lesson records, student profiles, invoices. You grant us a limited, non-exclusive licence to process and store this data solely to provide the platform's features to you.

Brightmark is provided "as is" and "as available" without any warranties, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components.

Brightmark is a productivity tool. We are not responsible for the accuracy of invoices or records you generate, or for any losses arising from your reliance on data in the platform.

Brightmark is provided free of charge. To the maximum extent permitted by Singapore law, Finedrawn Pte. Ltd. and its directors, employees, and contractors accept no liability for any loss or damage — direct, indirect, incidental, special, or consequential — arising from your use of or inability to use the platform.

Where applicable law does not permit a complete exclusion of liability, our total aggregate liability to you will not exceed SGD 1.

You may delete your account at any time from the app settings. Upon deletion, we will remove your personal data within 30 days in accordance with our Privacy Policy.

We may suspend or terminate your access if you violate these Terms, engage in fraudulent activity, or pose a risk to the platform or other users. We will notify you where practicable before taking such action.

We may update these Terms as the platform evolves. If we make material changes, we will notify you by email or via an in-app notice at least 14 days before the changes take effect. Continued use of Brightmark after that date constitutes acceptance of the updated Terms.

These Terms are governed by the laws of Singapore. Any dispute arising from these Terms or your use of Brightmark will be subject to the exclusive jurisdiction of the Singapore courts.
